The FCC has ruled federal and state communications are not subject to the TCPA.
Yet a new ruling out of a district court in Pennsylvania this week has sent shockwaves around the TCPAWorld by suggesting elected officials can be directly sued for communications sent by their office that violate the TCPA.
The ruling is now on appeal, but in the meantime government officials and staffers need to be very concerned about the impact of the TCPA on myriad outreach efforts.
