The TCPA remains the most dangerous statute out there and the biggest cash cow in American history for the plaintiff’s bar.
And it isn’t slowing down as news of another 7 figure settlement is out today.
A Blue Cross entity in North Carolina just agreed to pay $1.6MM along with Change Healthcare who apparently made robocalls to consumers in the state.
The allegations state the robocalls lacked consent and violated the TCPA. Looks like there are about 1,400 class members, which means the settlement is about $100 per head.. about right.
Per usual we would expect class counsel to make over $500k on this deal. So hundreds of thousands to the lawyers and just a hundred or so to the class.
Hey, better than some settlements.
The ruling met preliminary approval this week. Case is Stark v. Blue Cross and Blue Shield 2024 WL 3489367 (M.D. N.C. July 17, 2024).
