Erin Robertson receives hundreds of robocalls a day she didn’t ask for. Why?
Because a man in Nigeria named Igbinosa Obasuyi–who apparently resides in Lagos, Nigeria–has randomly been filling out hundreds of online webforms including her phone number and an American address.
Nobody has ever reached Obasuyi to ask him why he is behaving in such a bizarre way but Robertson has never met him and is left taking the heat.
At least, that’s her story.
Rather than remain a victim Robertson has decided to take action and file a massive number of federal lawsuits regarding the conduct– not against Obasuyi, however, but against the companies calling her.
Robertson has teamed up with the Wolf of TCPAWorld to file TCPA class action lawsuits–or at least make demands–against numerous companies who Robertson claims have called her illegally because of Obasuyi’s misconduct. She seeks millions of dollars in damages in these lawsuits on behalf of herself and class members she seeks to represent.
Then again, if Robertson is telling the truth the companies calling her are innocent victims as well–they typically paid a website operator for the lead submissions Obasuyi created, perhaps believing Obasuyi to be a legitimate consumer interested in goods or services from American businesses. These companies were not calling Robertson to harrass her and they were not cold calling her–they were calling because they believed a consumer was requesting contact.
Even if Robertson is telling the truth, therefore, it seems as if the TCPA is being abused here–leveraged against companies that seemingly had nothing to do with the injury-causing conduct and are being made to pay massive fines (the TCPA authorizes $500-$1,500.00 per call penalties) despite not doing anything wrong in the moral sense.
And, of course, Robertson might not be telling the truth. Nobody stands to gain from Obasuyi’s bizarre conduct except Ms. Robertson (and her lawyers) in the form of seemingly valid TCPA lawsuits she can file and cash in on. And given the massive fines Robertson stands to cash in for tens or hundreds of thousands of dollars based on Obasuyi’s conduct.
So might Robertson be working together with Obasuyi to set up these lawsuits?
Obviously Robterson’s lawyers deny this, but more than one company I am aware of claims to have valid leads from Erin Robertson (i.e. in Robertson’s name and from IP addresses matching her location). If this is true it would mean a woman allegedly receiving an ambush of unwanted calls is yet filling out forms seeking even more calls. That is highly suggestive something else is going on.
No matter what the truth is this all adds up to the most bizarre scenario I have ever seen in my long tenure as the Czar of TCPAWorld. Either Erin Robertson is the victim of the most intense robocall harassment scheme ever perpetuated and at the hands of a Nigerian national she claims to have never met. Or she is the most aggressively fraudulent TCPA litigator in history.
The only thing I know is that, either way, people need to stop calling this lady. So if you receive a lead from Igbinosa, go ahead and don’t call it. And if you receive a lead in the name of Erin Robertson reach out to me.
