Holy insanity.
We have been tracking the impressive increase in TCPA cases year over year but October was really one for the record books.
TCPA class action filings spiked 43% above October, 2022–continuing an overall trend of MUCH more TCPA class action activity in 2023 over 2022.
And if that wasn’t eye popping enough for you– 69% of all TCPA cases were filed as class actions. That’s 7 out of every 10 cases.
My goodness.
I have never seen anything like this– no one has. A federal statute that is generating many times more class actions than individual suits? Such a thing has never existed before.
Indeed, other statutes generate single digit class litigation.
Just unbelievable.
And once the FCC’s new ruling takes effect we can foresee a further spike in TCPA class litigation.
The TCPA really is a once in a generation opportunity for plaintiff’s lawyers to get rich, and man are they taking it.

No surprise here. The Robocall Index (TM) has been showing all year that 2023 is on track to be a “robocall epidemic.”. Either the telemarketers are not listening to their attorneys, or their attorneys are giving them bad legal advice, or they just do not care about the TCPA Whichever it is, kudos to those bringing on the lawsuits against these rabid telemarketers and making robocalling less profitable for them.
