Hi TCPAWorld! SoulCycle has been taken for a spin in court by Plaintiff Ian Difalco. After Plaintiff asked SoulCycle to “Stop” messaging him, he received an additional message almost a month later letting him know that “Warrior Week” was starting. Emergency purpose?
Based upon those messages, Plaintiff seeks to certify this class:
So as you probably already know, in order to recover for DNC violation, you need TWO illegal text/calls messages. Well, there are certainly two text messages here after the initial opt-out, but one is a confirmation of the opt-out.
Good case law to come of this…. I hope.
