Hi TCPAWorld! One of the newest serial TCPA Plaintiffs, Nigel Lucombe, is the named plaintiff in yet another TCPA class action in the Middle District of Florida—this time against Prestige Family Assets Group LLC. This is the seventh federal TCPA lawsuit he has brought in a three-month timeframe!!!
In this latest filing, Mr. Lucombe alleges that Prestige Family Assets Group engaged in unsolicited telemarketing practices by sending him multiple text messages and making phone calls without his consent to his cellular phone which has been registered on the National DNC Registry for about five years.
According to the complaint, between August 2023 and January 2024, Prestige Family Assets Group sent between three and seven unsolicited text messages and phone calls to Mr. Lucombe. The messages aimed to advertise and promote the company’s goods and services.
Mr. Lucombe is seeking to represent the following class:
DNC Class – All persons in the United States who from four years prior to the filing of this action through the date of class certification (1) Defendant, or anyone on Defendant’s behalf, (2) placed more than one phone call and/or text message within any 12-month period; (3) where the person’s telephone number that had been listed on the National Do Not Call Registry for at least thirty days; (4) regarding Defendant’s property, goods, and/or services; (5) who did not purchase or transact business with Defendant during eighteen months immediately preceding the date of the first phone call or text message; and (6) who did not contact Defendant during the three months immediately preceding the date of the first phone call or text message with an inquiry about a product, good, or service offered by Defendant.
Again, what makes this case particularly noteworthy is that it’s part of a series of TCPA lawsuits filed by Mr. Lucombe in the last three months. Again, he has become a named plaintiff in at least seven TCPA lawsuits (five being class actions), indicating a pattern of actively pursuing litigation against companies for alleged telemarketing violations.
