Interesting complaint filed against Swift Home Loans down in Florida.
These guys are allegedly hammering consumers with cold calls using trigger leads and then pretending to be the original mortgage source:
Defendant uses these leads as part of a high-pressure business model
aimed at intercepting consumers in the middle of their loan process or after it has
closed with another lender. Swift Home Loans then sends unsolicited telemarketing
text messages and calls to these consumers, often misrepresenting itself as affiliated
with the consumer’s existing lender or mortgage transaction. This practice not only
violates consumers’ privacy expectations, particularly for those listed on the National
Do Not Call Registry, but also contributes to widespread confusion, annoyance, and
harassment.
The allegations continue, quoting online reports:
My friend works there. He’s an absolute machine. This is all true. Those
guys are insane. They are literally the car salesman of mortgages. They wake up 5
AM, work out. Then after hitting the gym, They talk about how to grow their business. Then they get on the dials and dial the hell out of the world. And they
have every single product memorized by heart.
Another portion alleges:
They are the country’s worst offenders when it comes to credit triggers. They are almost exclusively ex rocket mortgage employees, generally the ones that were liars and manipulators on the phones. They are high skilled and highly motivated, killers. They call on triggers and pretend to be the original source of the credit pull, like literally saying they are the company that the person was working with calling from a different number. They will call a client many times on repeat day in and day out, bombarding them until they pick up…”
Eesh. Pretty bad stuff– if it is true.
The complaint seeks to represent a class of all individuals that were on the national DNC list at the time they received unsolicited text messages.
Ironically, however, this case is being brought in the very same district where another court just held SMS messages like the type received by the Plaintiff here are NOT actionable.
Will be very interesting to see if Plaintiff pushes the case forward or walks into a settlement now in light o the new case law development.
