Not long about I wrote about how a call to a guy named “Needle Dee” resulted in a potential $3.3 billion dollar exposure against the Federal Savings Bank.

FSB had bought a lead from a lead generator who called a fake name and a wrong number– the call was transferred to FSB, and now it faces enormous exposure.

But the TCPA gods aren’t done with it just yet.

In a new suit filed last Thursday a consumer named James Almond contends FSB bombarded him with SMS messages without his consent. This is true despite his alleged requests that the messages stop.

Almond has filed a TCPA class action against FSB in the E.D. Cal and if the allegations are true FSB has another massive TCPA headache on its hands.
