So not long ago I paused to reflect on whether Choice Home Warrant might be the least successful litigant in TCPA history.
They have been beat up– a lot.
And they seem to make awful defensive moves in the case that really look like self-inflicted wounds.
Bad bad bad.
Plus their litigation tactics don’t seem to be scaring anyone off.
For instance the Godfather himself–Abbas Kazerounian– just filed a new class action against CHW on Monday of this week.
The new suit–available here CHW Group Suit— alleges a series of unwanted promotional text messages received by the plaintiff.
The plaintiff Kyle Trauberman seeks to represent a class of:
All persons within the United States (1) registered on the National Do Not
Call Registry for at least 31 days, (2) who received more than one telephone
solicitation (3) made by or on behalf of Defendant, (4) for the purpose of
promoting Defendant’s goods or services, (5) within any twelve-month
period, (6) within the four years prior to the filing of the Complaint.
But this is just the tip of the tragic TCPA iceberg for CHW.
Looks like CHW was also sued in August by a lady named Yazmin Gonzalez in TCPA class action in Texas.
And by a lady named Virginia Johnson Gruver in a TCPA class action in Vegas back in April.
Oh, and by a guy named Leon Weingrad up in TCPA class action up in Oregon in March.
Oh, and by George Moore in a TCPA class action up in Chicago in February.
This is in addition to the three different suits in which they lost rulings in TCPA suits this year.
Eesh.
Five new TCPA class actions in a single year is pretty suggestive. There’s blood in the water here.
Not sure if it is the multiple losses that is attracting the sharks, if there is some payments being made that are exciting them, or if its just bad practices (or something else) but CHW is getting picked apart here.
