  1. Great episode! I know you guys are skeptical that someone can get so many spam calls without actively setting them up, but I absolutely believe David Tom. I’ve seen this same type of deluge happen to multiple people I know who have kept their landline phones. Several media outlets, including the New York Times, have run stories about this phenomenon in the past two weeks. Most of the calls are scams involving Medicare or burial insurance, and some people are getting 60 a day. Maybe this will start to slow down, as the Anti-Robocall Multistate Litigation Task Force has just announced a new crackdown on a few of the telcoms that are carrying a large amount of the bad traffic.

    It’s funny that you say (paraphrasing) “this is why people don’t like repeat litigators”. I would bet that most people who watch this interview will see David as quite likable, and will appreciate his vigilantism against those who are harassing our parents and grandparents and trying to plunder our future inheritances. It sounds like he tries to settle each claim before filing, so I don’t believe that he’s trying to kill small businesses. If he was, he’d jump in right away with a $5 million class action. But let’s be honest, the buck-passing in the telemarketing industry would be considered laughable in any other context. Small businesses go under all the time because they didn’t vet their suppliers, or they didn’t buy enough liability insurance, or they made a lousy hire who broke the law or did something negligent. I’m not sure why companies that continually buy bad leads and blast out illegal calls should get to play by different rules.

  2. Geez, flashback to the Watergate tapes…where is the missing 15 second audio between 42:00 and 42:15?!?!? When you asked him about other phone lines/#’s he may have?

    So because you claim to only get 2-3 calls a day, he must be manufacturing lawsuits since he gets 50+?!?!

    Hey, even you yourself have posted about the 45% lead gen fraud scenario…

    Your pleading for the ‘small biz’ facing extinction due to ‘inadvertent’ bad lead purchases – hey do they not read the contract they sign with lead gens?
    Rather than fold the biz, why not turn over the lead gen selling them the crap leads, or file counter-claims as Tom suggested??

    If it’s really that bad, just how many of the ‘small businesses’ are you defending pro bono?
