Well its the Third Day of Czarmas 2026 and my gift to you is the weirdest, wildest, and hardest hitting episode of Deserve to Win podcast yet.
Episode 39 brings together a rather strange combination– a free-form holiday episode from the Troutman Amin, LLP annual retreat, complete with festive attire and well wishes along with a notably somber yet highly-impactful interview with Jay Edelson regarding his incredibly important wrongful death actions against OpenAi.

Jay has been talking with all the big media outlets– so obviously he had to join Deserve to Win to discuss as well!
Edelson discusses the two cases he is pursuing on behalf of his clients against OpenAI– including one case involving a 16 year old who killed himself after OpenAI’s ChatGPT product allegedly encouraged him to move forward with the suicide.
In a second case a man suffering from mental health issues allegedly had his delusions fed into by ChatGPT to the point that he engaged in murder.
This is some VERY serious content that is highly impactful and raises deep philosophical and legal issues as well as some very heavy and somber topics.
Unfortunately the weight of the interview clashes substantially with the light tone of the holiday episode and the black silk PJs I wear during the interview make for an unintendedly absurdist contrast to the seriousness of the topics Jay and I discuss.
Cant imagine a more jarring–and yet compelling–contrast in tone and content in a podcast. The entire thing is just utterly captivating even if sometimes feels bizarre to see Jay and I take on heavy topics while I’m wearing a Santa hat.
The interview with Jay is absolutely amazing, however. The guy pulls no punches–overtly suggesting OpenAI’ counsel is completely screwing up the case and pointing out several examples of what he deems to be poor lawyering tactics being deployed.
Plus his rendition of the facts of the cases (which I did not independently verify and are presented only as allegations) will leave even the most skeptical observer wondering what the hell OpenAI is doing and whether ChatGPT might be a risk to users and the broader community alike.
Its all here in the grand wrap up episode that sends 2025 to the annals of history and sets the stage for the greatest year yet!
