Chet Michael Wilson may not be the fiercest of TCPA litigators but he is making short work of Medvici right now.
Winners win, as the saying goes.
If so, then repeat TCPA litigator Chet Michael Wilson might well be a winner given his serial victories the medical clinic.
Previously Wilson defeated Medvici’s claim that SMS messages are not calls under the TCPA.
In the latest round, Wilson defeated Medvici’s claim that the messages at issue somehow are not attributable to it.
In Wilson v. Medvici, 2026 WL 145955 (N.D. Cal. Jan. 20, 2026) the court found Medvici’s motion to dismiss an amended complaint to be completely lacking in merit:
[T]he SAC alleges that the messages bore indicia linking their source to MEDVIDI, advertised MEDVIDI’s telehealth
platform, and contained hyperlinks leadings to MEDVIDI’s website. These allegations are sufficiently concrete to establish a
plausible inference that MEDVIDI in fact sent the challenged communications.
Yeah, this is pretty straightforward.
Looks like Medvici is represented by some sort of healthcare law firm–Frier & Levitt, LLC– so we can imagine how this TCPA class action defense against the Wolf is going to go. (Probably not well.)
