TROUBLE ON THE HORIZON: Medicredit Facing $450MM in Exposure for Wrong Number Robocalls Calls in Certified TCPA Class Action–And is Morgan & Morgan Back in the Game?

They claim to be the biggest plaintiff’s firm in the country– and maybe they are.

But they’re just a bunch of car crash lawyers right?

Well maybe not.

Many years ago a guy named Billy Howard ran a group at Morgan & Morgan that brought consumer protection cases– including under the TCPA.

He ended up leaving to start his own firm and the group fell to Tav Gomez.

Now long after he left and when he did Morgan & Morgan got out of the consumer protection game, seemingly to focus on car crashes (much easier to shakedown insurance companies than small businesses after all.)

But now Morgan & Morgan appears to be back in the TCPA game and teaming up with a bunch of TCPAWorld hitters. And that’s actually incredibly frightening.

Take the case of Saggio v. Medicredit, 2026 WL 183533 (E.D. Mo. Jan. 23, 2026).

There the court certified a TCPA class action against Medicredit involving 300,000 calls its own records indicated might have been to wrong numbers. (Important take aways from this I can’t put in writing but you should call me if you have concerns– and you should.)

Medicredit hired Spencer Fane– a #biglaw group that just absorbed a bunch of lawyers from the collapsing McGlinchey Stafford– and they appear to have done their best here. But it wasn’t good enough.

But a #biglaw firm losing a TCPA certification effort is old hat, of course they lost. #BigLaw basically ALWAYS loses in TCPA suits. That’s barely even a story at this point.

The story is the plaintiff’s attorney lineup.

Check this out Avi Kaufman, Billy Howard, Amanda Allen AND Morgan & Morgan all on the same case.

Now, this case was filed back in 2022. So it is possible Morgan & Morgan is just “seeing this one through” and it arose back when Howard was still with the firm but I don’t think so.

This looks like a very dangerous return to the game for M&M. And with their resources, TCPAWorld could really become an even scarier place.

Will keep a very close eye on this.

For now though Medicredit is facing about half a billion in exposure here but at least they’ll provide an EXCELLENT cautionary tale to discuss at Law Conference of Champions in a couple months. Have your tickets to the GREATEST compliance show on Earth yet?

    Curiously they don’t mention the fact they’ve been nailed for using GenAI/ChatGPT to cite non-existent cases in their filings (try 8 out of 9!!!!!) Yeah M&M you brag about 1,000+ atty’s and you can’t bother to fact check your docs!?!?! In fact even one of the Morgan clan (just how many are there?!) signed off on the fabricated doc!!!
