We all hate unwanted robocalls–especially about scammy products.
Well the folks behind the regrettable LikeLock product (my opinion)–Gen Digital–just agreed to pay nearly $10MM to resolve a TCPA class action alleging it sent wrong number robocalls regarding Lifelock accounts to about 300,000 people. But I’m wondering– is that enough?
This is pretty egregious conduct. And this is the same company that just had to pay $55MM on a false claims act loss to the government. This is not a good company IMO. So when I see them getting off easy for blasting consumers with robocalls without consent it makes me uneasy.
The case is Jackson v. Gen Digital 2026 WL 221110 (D. Az. Jan 28, 2026) and the class is defined as:
All persons throughout the United States (1) to whom Gen Digital Inc. placed, or caused to be placed,
a call regarding a LifeLock or Norton account, (2) directed to a telephone number assigned to a cellular
telephone service, but not assigned to a person who has or had a LifeLock or Norton account with Gen
Digital Inc., (3) in connection with which Gen Digital Inc. used or caused to be used an artificial or
prerecorded voice, (4) from February 19, 2021 to October 30, 2025.
The 15BB publicly-traded company allegedly made illegal wrong number robocalls to more than 300,000 telephone numbers– meaning the company’s exposure was at least $150,000,000.00 here– yet it is settling for less than 7 cents on the dollar.
I rarely say this–I’m a defense attorney after all– but I wonder if Gen Digital got off a little too easy. These are exactly the sorts of calls the TCPA is designed to prevent. And the sort of calls that might confuse and damage consumers. I don’t like it one bit.
Plaintiffs in the suit are represented by the Wolf and Mr. Number One– who else– and they’ll make about $3MM on this deals, but I’m a bit surprised to see Gen Digital set to walk away for under $20MM on this one. Maybe the court will scrutinize the deal, we’ll see.
