GOOD SETTLEMENT!: OptumRX Earns Itself a Nice Settlement in TCPA Robocall Class Action Involving the Wolf and Mr. Number One

Another day, another seven figure TCPA settlement.

But this one actually looks really good.

OptumRX has agreed to settle a robocall class action for $1.8MM.

There were over 155,000 people in the class– which means Optum is getting a nice juicy release for only $11.60 per class member!

Now we’re talking!

And notably this is one of Mr. Number One’s famous wrong number robocall class actions. So this is a real steal for Optum. Class definition is:

All persons throughout the United States (1) to whom OptumRx, Inc. placed, or caused to be placed,
a clinical adherence call, other than calls regarding prescription refill reminders or calls regarding
COVID-19 vaccines, (2) directed to a number assigned to a cellular telephone or VOIP service, but not
assigned to an OptumRx, Inc. customer or account holder, (3) in connection with which OptumRx, Inc.
used, or caused to be used, an artificial or prerecorded voice, (4) from April 20, 2020 through October
22, 2025.

And per the settlement agreement there were 155,244 individuals in the class.

The case is Patterson v. OptumRX. 2026 WL 881674 (S.D. Ind. March 31, 2026).

I don’t understand why Optum sent over 150,000 wrong number calls– but it will cost them a seemingly low $1.8MM for doing so.

Plus, the cy pres here wasn’t the NCLC– yay!– although it was the only slightly better National Legal Aid and Defender Association. Hahaha.

Ya’ll should be looking at R.E.A.C.H for these folks! Tax exempt organization dedicated to stopping unwanted robocalls and cleaning up the lead generation industry through education and standards. Literally the PERFECT cy pres for a TCPA class action!

Looks like the good folks over at Hogan Lovells delivered this result. I think they may land on my Defense-side power rankings this year. This is legitimately good work.

May need to get Greenwald on stage at Law Conference of Champions one of these days to ask him about this settlement. Especially with Tom Alvord’s LawHQ hot on his heels in the latest power rankings!

Tom, of course, will be on stage at LCOC IV. Hope you have your tickets!
