WAIT!: No Weekend For You… Until You Check Out These GREAT Clips of Our Interview With Josh Swigart!

So I’ve been teasing this episode for a long time and the clips are FINALLY here.

The good news? They are ABSOLUTELY worth the wait. In fact, these are–without question–the best clips to date.

First, watch this quick clip to hear the Czar (this guy) tell the story of his very first TCPA class action. And it isn’t just an arbitrary tale. Our guest Josh Swigart–one of the ORIGINAL TCPA filers–was the guy I litigated my very first TCPA class action against. Here’s the story:

Next you can’t miss the incredible story as to how the Marks Ninth Circuit TCPA appellate decision came to be. Josh was one of two lawyers slated to potentially argue the appeal and it came down to a coin flip! As Josh says “THANK GOD I LOST!” He explains how Abbas lived and breathed the appeal for weeks before his successful argument:

And in what is probably the most AMAZING clip in the history of my long-running podcast series, Josh tells me how he was actively trying to settle Marks on an individual basis BEFORE the appeal. They were scared to death of the case and did not want to see it through. But the DEFENSE refused to settle–only to suffer probably the BIGGEST LOSS in the history of the TCPAWorld. My goodness:

Josh explains how Marks almost never came to be because they wanted to settle–but Defendant-who ended up losing on appeal and blowing open the TCPA’s ATDS definition coast to coast- wouldn’t settle! For more AMAZING content follow our INCREDIBLE You Tube Channel.

Finally, I share a chuckle with Josh over Sergei Lemberg–love you man– deciding to move forward with the Facebook appeal despite the fact that he appeared to be drawing dead before a textualist court (and went on to lose the case unanimously.)

As Josh tells it, most folks knew Duguid was going to come out against the Plaintiff’s bar, and as soon as oral argument was over he was frantically trying to settle his ATDS cases:

Too good.

I will likely post the entire episode–which is focused on CIPA and privacy claims–this weekend (CIPA Sunday!). But wanted to tantalize you folks before you headed out the door.

Chat soon.
