So TCPAWorld.com broke the news yesterday of a new bill in Congress sponsored by Representative Frank Pallone.
The bill would modify the definition of ATDS–well, really destroy it and replace it with the vulgarity “robocalls” as a shorthand for regulated technology–and require disclosures for the use of AI in marketing. Really fascinating.
I asked the good Duke to prepare a redline of the TCPA accounting for the new edits and here is what he has come back with.

As you can see the bill erases the definition “automatic telephone dialing system” and then literally uses the term–without definition–as part of the definition of “robocall.?
Egads.
The bill also includes a new definition of text message, which you can check out here:

So a “text” message includes any message consisting of “images, sounds, or other information.” Not sure these guys know what “text” means. Also, pretty sure sending a Snap, Marco Polo (cool ap) or TikTok constitutes a text message under this definition–and that tells you everything you need to know about how thought out this is.
