Great news for everyone.
In an unexpected voice vote the U.S. Senate today approved Olivia Trusty as the third FCC Commissioner.
This is an absolutely critical development following Commissioners Simington and Starks stepping down in the last two weeks.
The FCC was momentarily unable to act and with the BBB tying up the Senate it looked like the FCC might be entirely neutered for a few months.

However, the process worked (for once.)
The Senate got its act together and pushed through an extraordinary voice approval of Trusty.
To be clear, Trusty’s approval was never in doubt. Everyone I talked to agreed that she was a shoe in for approval it was just a matter of getting the Senate to pay attention to the FCC nomination.
And with the Commission essentially shelved–it was down to just two Commissioners– the Senate acted quickly to bring Trusty into the fold.
This move assures the FCC can now move forward with important initiatives as the Commission has the required 3 commissioners to form a quroum.
Huge webinar– changing the world?
A few people have already asked whether my webinar with Ferree yesterday–in which I advised everyone the FCC had essentially melted down and couldn’t act without Trusty– may have pushed the Senate to act.
Its possible, but I don’t know that. So I will not take full credit for this development.
