While the cases are starting to slow down, one particular plaintiff– Jan Carlos Pimentel–has filed 19 SMS quiet hours cases in just the last few months.

Looks like Pimentel is mostly focused on insurance and finance companies.

  1. Telemarketers that call during quiet hours deserve to be sued. Is their defense going to be that the autodialer uses a random number generator to tell time?
