When TCPAWorld reported on the ATDS case surviving the pleadings stage recently I had a bad feeling we were about to see more of these arguments.
And now– in a classic canary-coalmine moment– serial litigator and famed “Sherriff” of TCPAWorld Mark Dobronski has sued Rocket Mortgage claiming it called his phone using an ATDS.
This feels watershedy because Rocket Mortgage is regularly sued under the TCPA for allegedly aggressive telemarketing practices an, of course, Dobronski has made himself into he next Diana Mey, bringing TCPA suits and outgunning #biglaw shops all by his lonesome.
We will have to wait and see how this turns out, but where Dobronski goes the plaintiff’s bar likely isn’t far behind.

Also did you hear about that other lawyer who claims to know about the TCPA who published an article saying you DON’T have to register in Texas if you have consent for marketing calls? CRAZY WRONG.

Troutman’s charging $6,000 an hour now? Man, he’s got some serious stadium signage to pay for. I’d probably pay that for a good TCPA attorney, but the only person who might sue me under the TCPA is the girl I dated years ago and sent twenty messages in an unsolicited manner.
And I’m afraid that Eric doesn’t get involved in these sorts of emotionally charged disputes. Besides, we dated. It was implicit consent.

I think its interesting that Mark has included a claim for the abandoned calls. This is something I have not seen before. Will be interesting to see how Rocket responds. Good on Eric for supporting Cal Bears. The placement in center field is a big improvement over the banner near the Spirit gate at John Wayne.
