Been an awful lot of apologizing to the court lately.
The best read story of the year so far is that of McGuireWoods managing partner Tracy Walker IV apologizing to the Court on behalf of his entire firm for a “portfolio” attorney submitting fake cites to the court.
Well now we have another declaration of apology to report– this time involving an angry outburst by Lucas B. Horton.
Horton is a repeat litigator who up until recently had a successful career bringing TCPA class action lawsuits. Just search “Horton” on TCPAWorld to see all the fun things he has accomplished.
Well it seems as if his litigator career may be coming to a close at the hands of PivotHealth.
In PivotHealth Holdings, LLC v. Lucas Horton, Case No. 2:24-cv-01786-SHD (D. Az.), Pivot is accusing Horton of forging a document in an effort to support an allegedly frivolous lawsuit.
In connection with that case Horton was deposed and apparently exploded on the examining lawyer in a profanity-laced tirade that was caught on tape and later presented to the court.
That lead to Horton filing a declaration yesterday apologizing to the court (but not to counsel) for his “mental health issues.”
Here is what he says:
I have seen various kinds of doctors and been on medications off and since I was a child.
I have been treated for anxiety, mood stabilization, depression, among other things.
Exhibit A is a record from Tom Thumb of some of prescriptions.
I will go from 1 to 100 in terms of my temper extremely quickly when something sets me off and once I get to 100, it is very hard to calm down. Especially if whatever of bothering me won’t stop.
Fitzgerald asking me the same questions over and over again concerning things that were not relevant such as my mortgage triggered me. Badly. I really needed an attorney to be there to keep me in check, but I was not able to find anyone who would represent me in this.
I apologize to the court for my behavior. I know it was wrong and would always not prefer to lose it as I did.

So there you go.
Horton has anger management issues and we may never hear from him in a TCPA suit again.

If I had to rate that apology from1 to 100 on how badly it set my anger off from how horrible it was, I’d rate it at 100. “I have mental health issues, therefore, it excuses my behavior” is an excuse, not an apology. – written by someone who also has anxiety and depression . . . .
Interesting fodder. But, the prescriptions highlighted were from 2022, and we are now in 2026. So, did this outburst happen in 2022?
