TCPA RISK UP 20% TO START THE YEAR!: February, 2026 TCPA Class Action Filings Spike to Record 211 New Complaint– And 2026 is Suddenly Eclipsing the MONSTER that Was 2025

So 2025 was famously the biggest year for TCPA class action filings in the statute’s history.

And, of course, 2024 was previously the biggest year.

And, of course, it looks like 2026 will soon become the biggest year.

Overall TCPA filings are up 26.8% year to date but it is always the class action filings we are concerned with.

A class action, of course, is a combination of EVERYONE that may have suffered a violation of the TCPA from the same defendant pursuing claims at the same time in a single case. The damages in such TCPA class actions can be simply enormous– eclipsing a billion dollars rather commonly.

This is why the TCPA is considered the most dangerous statute on the books and why only the most sophisticated (and expensive) attorneys on the planet make their living handling the complex federal court litigation rising from these claims.

Well in good news for super-expensive attorneys and bad news for everyone else– the TCPA class action count continues to rise.

In February, 2026 the nation endured 211 such filings.

Last year there were only 148.

That’s a 43% jump year over year.

Yikes!

There were 172 class actions filed in January, 2025 meaning through February. 2025 a total of 320 TCPA class actions had been filed through the end of February, 2025.

This year started off with January at a mere 170 class actions (actually down 2 from last year) but the spike in February sees the overall number of TCPA class actions rising to 381– a 20% increase from last year.

But watch this.

If we go back to 2024–just two years ago– there were a total of only 91 TCPA class actions filed in February, 2024 and in February, 2023 there were only 53 filed.

So that means TCPA class action filings have QUADRUPLED in just three years.
