MOVING FORWARD: Senate Version of “Protecting American Consumers from Robocalls Act” Sent to Committee–Would Increase Damages for DNC Violations

We have been covering the disastrous new effort by Democrats in Congress to expand the TCPA at the behest of the NCLC (read: rich Plaintiff’s attorneys.) Well the bill is moving with speed now in the Senate with Senator Durbin having the bill read twice and submitted to committee recently.

Like the House bill the Senate version of the bill would also remove the term “residential” from the DNC rule and also expand the ATDS definition– two critical changes that will make it much easier to sue small businesses (and large) in TCPA suits.

The senate version also drops the “up to” limitation in 227(c) private right of action–thus making DNC claims equal to regulated technology claims under 227(b) in terms of mandatory $500.00 per violation damages.

Not good.

Will keep an eye on this and discuss at Law Conference of Champions next week!!!

Show is sold out in person but virtual passes are available– and its an amazing four camera set up you will really want to be a part of!! Virtual option presented by Caller Id Reputation.
