HEAT WAVE: TCPA Class Action Filings Continue to Cook the Nation at a Record Pace as Summer Heats Up

Its getting hot in TCPAWorld.

Too hot.

The massive 2026 TCPA heat wave continues to hammer the nation with no relief in sight.

Numbers from R.E.A.C.H. member Webrecon show a total of 270 TCPA cases and 216 Class Actions filed in May, 2026. While these numbers are down from April they are up massively year over year.

This is a 35.7% increase in TCPA filings from May, 2026 and a 35.8% increase in TCPA class action filings.

Through May, 2026 there have been a total of 1,072 TCPA class actions filed compared to 850 through May, 2025– an increase of 26% YoY.

Cannot emphasize enough how big of a deal this is. As TCPAWorld readers know 2025 saw the highest volume of TCPA filings ever– that 2026 is tracking at a 26% gain over last year’s number should concern everyone out there.

Each one of these cases is potentially a multi-billion dollar case capable of ending every business served and bankrupting individual officers, directors or managers. Scary stuff/

TCPA compliance remains an absolute must– and companies that don’t have lawyers on their team risk massive risk.

Importantly, many companies are turning to non-attorney consultants or AI for TCPA compliance assistance and these companies are getting smoked in court as their communications are not privileged– meaning they have to turn over searches, audit reports and analysis they thought was secret and internal. Terrible stuff.
