REMEMBER TO STAY!: Court Grants Stay of Discovery Pending Arbitration Motion Determination– and This is an Important Technique to Keep In Mind

Compelling arbitration can be one of the most powerful weapons in your class action defense arsenal.

Not only can success on the motion destroy the class action– even if you lose the arbitration motion you can seek an appeal and stay the case for years. This is strong stuff.

Many lawyers overlook the power of the arbitration motion to stay the lower court proceedings even while the motion is pending, however. Troutman Amin, LLP has been bringing these motions together for years– and they pay off.

For instance in Sanchez v. Insureus 2026 WL 2099366 (E.D. Cal. July 21, 2026) the court just showed us how powerful an arbitration motion can be when coupled with a stay effort.

In Sanchez the Plaintiff sued claiming Insureus had bought leads from SharpCoverage, and that those leads were invalid. Luckily or Insureus, however, SharpCoverage’s website apparently had an arbitration provision and Insureus moved to compel arbitration.

Insureus also moved to stay discovery pending the outcome of the arbitration determination and the court granted it!

The court took a “preliminary peek” at the arbitration motion and found it had some merit– always a good thing– and on that basis decided to prevent discovery from moving forward until the court determined whether arbitration was appropriate.

Notice Insureus still might lose the arbitration motion–th at issue wasn’t decided– but the expense of discovery has now been taken off the table. And, as noted before, even if Insureus loses the arbitration effort it can appeal– meaning this case is on ice for the foreseeable future.
