  1. I simply refuse to believe it. Fraud in the lead-generation industry? Surely not.

    Everyone knows that telemarketers and lead generators are scrupulously honest people who would never fabricate a lead, manufacture consent, insert a consumer’s telephone number into a lead record after the fact, or pass around questionable “consent” data until nobody can quite explain where it originally came from.

    And, of course, telemarketers invariably honor the National Do Not Call Registry. They would never call a registered number without permission. They certainly would never use prerecorded messages without the required prior express written consent. And I cannot imagine anyone producing a pristine-looking lead certificate after being challenged and insisting that it proves the consumer consented.

    So this claim that as much as 40% of the lead-generation industry may involve fraud must surely be a terrible misunderstanding.

    Because if lead fraud really were that pervasive, one might begin to wonder whether a “lead” or “consent certificate” should be treated as evidence of consent merely because a defendant or its vendor says that it is.

    And that could lead to all sorts of uncomfortable questions about where these leads actually came from, who created them, when they were created, what data existed at the time of the supposed consent, and whether anyone bothered to verify any of it before dialing the consumer.

    Perish the thought.
