ITS OFFICIAL!: Governor DeSantis has Signed the Amendment Killing the Florida Mini-TCPA!

Well folks in Florida are about to start getting a lot more robocalls and texts.

It has been quite a week for Ron DeSantis–Run for president. Make it easier for robocallers and texters to target Florida. Some other stuff, I am sure.

It was all going so well…

Naturally we here at TCPAWorld are more focused on the positive effects of the new amendments to the Florida Telephone Solicitation Act–namely the end of so many frivolous FTSA class actions.

But still, it is a bit odd for a newly-minted presidential nominee to put himself in harm’s way by approving an amendment that will make it VERY hard for folks in his state to sue robocallers.

With the new amendments in place the battle now turns to the courthouse where FTSA defendants will argue the amendment works backward in time via a retroactivity provision and seek to dismiss all pending putative FTSA class actions. (Of course all of the state FTSA cases should be dismissed under Eldridge anyway.)

But don’t forget — we now have OTSA out there.
