Web Recon just dropped its April data set and the numbers are eye popping.
Another 92 TCPA class actions were filed in April. That means 68.1% of TCPA cases filed that month were class actions. The highest percentage in history–again.
More importantly, TCPA class action filings are up over 39% from last year!
That is 331 TCPA class actions filed Jan-April, 2024 compared to 238 that period last year.
And, of course, last year was already a record breaking year.

2024 filings are smoking 2023–and those were way higher than 2022!

Telemarketing calls are up, so it stands to reason so are the lawsuits arising therefrom. The “final expense” folks are really getting out of hand. Today, alone I have endured 18 calls… And every time I said “do not call me” I got some choice 4 letter words uttered at me as they hung up. It appears some of the big FE insurance companies really should partake in your LCOC seminars.
It’s remarkable how many of the spam calls from the past few years pertain to some kind of insurance or warranty product. Certainly, no legitimate insurance company is selling their products this way, and anyone who buys such a policy from a cold caller is going to find that it is worthless. These “final expense” and auto warranty calls are not telemarketing – they are criminal racketeering.
I have a friend who is in a nursing home right now recovering from surgery, and she has had to disconnect the phone in her room because it rings every hour with a call like this. I answered one of these calls when I was visiting her, and it was a foreign call center saying they were with “American Directives” and were selling insurance – which I know is a scam because there’s no such company registered in this state. And due to the Facebook loophole, these calls (clearly made with an autodialer) no longer violate the TCPA as long as they use a list of numbers to specifically target nursing home patients! The FCC has done a good job at shutting down some types of illegal calls from overseas, but they are powerless to act when the scammers are complying with their rules.
Lawyers gonna lawyer. Only profession where they can write the very laws they then turn around and sue on. If folks had any brain at all, they would go after actual bad actors and not just add a crap ton of regulation that makes it extremely confusing and hard for the 99.9% of SMBs who don’t do bad things. But hey… lawyers gonna lawyer. Good on the them for making sure 99.9% of us suffer because .01% is bad. Thanks lawyers. Where’s that Supreme Court decision on having AI lawyers… we need to knock the mob.. I mean lawyers down a notch.
