CRAIG CUNNINGHAM HELD IN CONTEMPT!: Is He Going to Jail?

Subpoenas in TCPAWorld have been leading to a lot of trouble lately. 

Like, go to jail trouble.

Usually the trouble arises when a third-party commanded to produce documents pursuant to a subpoena fails to respond properly.

But sometimes trouble can impact the party issuing an improper subpoena–and that’s what happened to repeat TCPA litigator Craig Cunningham.

So late last year Cunningham issued a subpoena that was quashed by the court. The Court also issued monetary sanctions in favor of the defendants in the amount of over $11k and ordered Cunningham to pay within 30 days.

Apparently Cunningham did not pay up and the Defendants moved to hold Cunningham in contempt.

Well last week the Court granted the motion and Cunningham has officially been held in contempt of court!

In addition to now having to pay more fees the Court will consider a further penalty for Cunningham–which theoretically could land him in jail!

Just fascinating. Here is the core outcome of the ruling:

Within fourteen (14) days hereof, the MJ Ministries Defendants shall submit paperwork detailing: (1) their fees and costs incurred in connection with their Motion; and (2) any other relief they believe is appropriate under the circumstances.

Eesh.

The ruling is in Cunningham v. Jordon, et al. Case No. 22-cv-01419, Doc. No. 80 (N.D. Ga. Feb. 21, 2025)

We will definitely keep an eye on this one.
