I know a number of you are eager to learn the fate of the big Florida robocall bill.
As the federal TCPA appears to be limited only to pre-recorded calling technology following Facebook–that big win for Aspect today is really important–the big threat to autodialer users are now state enactments. And the Florida bill–which contains no definition of autodialer, at all–with its massive statutory damages tracking the TCPA, is a real concern.
The bill passed unanimously and was enrolled a while back but it STILL has not been presented to the governor yet. Once presented DeSantis will have 15 days to veto or sign the bill or it becomes law.
Observers tell me that it is highly unlikely the bill is vetoed, so this is more an issue of when rather than whether the bill becomes law.
Of note– the law takes effect July 1 if signed. So hold onto your hats.
