Last week was a busy week in Florida!
Queenie reported on the amendments to the Florida Telephone Solicitation Act (“FTSA”).
The Boca Raton FAU Owls made it to the 🏀 Final Four 🏀for the first time in school history and the University of Miami Canes made a Final Four appearance as well. Both teams had a great run!
To close out the week, the Czar’s Power Ranking No. 2 filed three new cases in Florida. As the Czar said, “Now, more than ever, take any filings from his office seriously.”
In Jonathan Banakos v. HealthCompare Inc. and Digital Thrive, LLC., No. 23-CV-00566 (MDFL), Banakos alleges that HealthCompare and its telemarketers use automated systems to make telemarketing calls into Florida as well as to Florida residents that have placed themselves on the National Do Not Call Registry, and that by doing so, HealthCompare has violated the provisions of the Florida Telephone Solicitations Act. This case also involves a campaign by HealthCompare to market its services through the use of pre-recorded telemarketing calls in violation of the TCPA. Banakos seeks to certify three classes: TCPA Robocall Class, FTSA Autodial Class and FTSA Do Not Call Registry Class.
Next up is Tiffany Harris v. MSPowermail LLC and Advocate Health LLC. No. 23-CV-00696 (MDFL). Harris alleges that despite being registered on the DNC Registry, she received telemarketing calls from MSPowermail as part of its calling for Advocate Health. Harris seeks to certify one class: the National DNC Class.
Last but certainly not least is Robin Taylor v. Suntuity Solar LLC., No. 23-CV-694 (MDFL). This case involves a campaign by Suntuity Solar Company to market its services through the use of telemarketing calls to individuals who listed their telephone numbers on the National Do Not Call Registry in violation of the TCPA. Taylor also alleges that Suntuity Solar Company uses automated systems to make telemarketing calls to Florida residents, and that by doing so, Suntuity Solar Company has violated the provisions of the Florida Telephone Solicitations Act, Fla. Sta § 501.059. Taylor seeks to certify three classes: FTSA Autodial Class, FTSA Do Not Call Class and TCPA Do Not Call Registry Class.
